1. Acceptance of these terms

These Terms of Service (the "Terms") govern your use of avitka.com (the "Site") and any purchase you make from it. The Site is operated by Avitka LLC, a Missouri limited liability company located at 1317 Hwy H, Liberty, MO 64068, USA ("Avitka," "we," "us"). By browsing the Site or placing an order, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.

You must be at least 18 years old to place an order. Our products, including playsets, are sold to adults.

2. Who we are and where we sell

Avitka sells outdoor power equipment and outdoor living products: ride mowers, walk-behind mowers, portable generators, yard and cleanup equipment, playsets and swing sets, and pergolas and gazebos.

We cannot deliver to PO boxes. Freight needs a street address with truck access. We do not ship to military APO/FPO addresses, or outside the United States. Orders that cannot be delivered to an eligible address may be cancelled and refunded.

3. Product information

We work to keep product names, descriptions, specifications, dimensions, images, and availability accurate. Descriptions are based on information from the manufacturer and our distributors, and manufacturers can change specifications, colors, or included parts without notice. Photos are for illustration and your unit may differ slightly in appearance.

Before you buy, please review the specifications and the manufacturer's manual for the product, and confirm that it fits your property, power needs, and local rules. If something on a product page looks wrong or unclear, contact us and we will check it before you order.

4. Pricing and pricing errors

All prices are in U.S. dollars. Delivery within the U.S. is free on every order. Applicable sales tax is calculated and shown at checkout, and accepted payment methods are also shown at checkout.

Prices and availability can change without notice. Despite our efforts, a product may occasionally be listed at an incorrect price because of a typographical or system error. If we find a pricing error on an item you ordered, we will contact you before shipping and offer you the choice to confirm the order at the correct price or cancel it for a full refund. We are not required to fill an order placed at an obviously incorrect price.

5. Orders and acceptance

When you place an order, you will receive an email confirming that we received it. That confirmation is not our acceptance of the order. We accept an order when we ship it and send you shipping confirmation. We may decline or cancel an order, for example because of a pricing error, a stock problem, an undeliverable address, or a payment issue, and if we do we will refund any amount you paid.

You agree to provide accurate billing and delivery information, including a phone number so the freight carrier can schedule delivery. Questions about payment are covered on our Payments & Billing page.

6. Shipping, returns, cancellation, and warranty

• Shipping: Shipping Policy and Freight Shipping Policy. Orders ship within 1 business day, and delivery is typically 3-7 business days after shipping.
• Returns and refunds: Refund & Returns Policy. You have 30 days from delivery to request a return of an unused, unassembled item in its original packaging.
• Cancellation: Cancellation Policy. We cancel at no charge before an order ships.
• Warranty: Warranty & Replacement. Products carry the manufacturer's warranty. You may contact the manufacturer directly, or contact us and we will help you file the claim.

7. Intellectual property

The Site's text, layout, graphics, and our own logo and name are owned by Avitka LLC or used with permission, and are protected by U.S. copyright and trademark law. Product names, brand names, logos, and manufacturer images belong to their respective owners and are used only to identify the products we sell. You may view and print pages for your personal, non-commercial use. You may not copy, scrape, republish, or reuse Site content for commercial purposes without our written permission.

8. User conduct

When using the Site, you agree not to:

• provide false or misleading information, or place an order using someone else's payment details without permission;
• interfere with the Site or its security, or attempt to access accounts, systems, or data that are not yours;
• use bots, scrapers, or other automated tools to collect content or place orders without our written permission;
• submit unlawful, abusive, or harassing content through our forms or reviews; or
• use the Site for any purpose that violates applicable law.

9. Product use and safety

Outdoor power equipment and play structures can cause injury if misused. Read and follow the manufacturer's manual and warnings, complete assembly correctly, and supervise children around playsets and machinery. See our Disclaimer for general safety guidance. 10. Limitation of liability

Except for the manufacturer's warranty and the rights you have under applicable law, Avitka LLC's total liability to you for any claim arising out of your purchase or use of the Site is limited to the amount you paid for the product that is the subject of the claim. Except as applicable law requires otherwise, we are not liable for indirect, incidental, special, or consequential damages, such as lost income or lost use, arising from your use of the Site or a purchase.

Nothing in these Terms limits liability that cannot be limited by law, including liability for our own fraud or for death or personal injury caused by our negligence where the law does not allow it to be limited. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

11. Governing law and disputes

These Terms are governed by the laws of the State of Missouri, without regard to its conflict-of-law rules. Any dispute that cannot be resolved informally will be brought in the courts located in Clay County, Missouri, and you and Avitka consent to those courts' jurisdiction. Before starting any formal process, please contact us first and we will work to resolve the issue quickly.

12. Changes to these terms

We may update these Terms from time to time. The "Last updated" date at the top shows the current version. Changes apply to the Site from the date they are posted, and orders you have already placed remain subject to the Terms in effect when you placed them. Continued use of the Site after a change means you accept the updated Terms.

If any part of these Terms is found unenforceable, the rest remains in effect.
